1. Introduction and Acceptance of Terms

Welcome to MiroFish ("MiroFish," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our AI scenario prediction service available at mirofishai.org (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

MiroFish is an AI-powered scenario prediction tool. You submit a topic, decision, or "what-if" question, and the Service generates a structured prediction report by simulating how different stakeholders are likely to react. Each report includes stakeholder analysis, sentiment trajectories, narrative breakdowns, risks, a confidence score, and a final prediction summary.

The Service is powered by a dual-model architecture: Google Gemini 2.5 Flash is used to extract stakeholders and simulate discussions, and Anthropic Claude Opus 4.6 is used to analyze the simulation data and produce the final report. Both models are accessed via OpenRouter.

Outputs are generated by AI based on your inputs. Reports are scenario simulations, not factual forecasts. See Section 10 for important disclaimers.

3. Eligibility and User Accounts

Eligibility: You must be at least 13 years old to use the Service.
Account Creation: To use core features, you may need to create an account and provide accurate information.
Account Security: You are responsible for maintaining the confidentiality of your credentials and all activity under your account. Notify us promptly if you suspect unauthorized access.

4. Subscription Plans and Credits

4.1 Credit System

The Service uses a credit-based system where 1 prediction report = 10 credits.
Each topic prompt has a maximum length of 5,000 characters.
You may optionally upload one supporting document per prediction (PDF, Markdown, or plain text, up to 30 MB).
MiroFish does not offer a free tier. An active paid subscription is required to generate predictions.
Paid subscribers receive monthly credit allocations as shown on the pricing page.

4.2 Allocation and Expiration

For monthly subscriptions: credits are allocated at the start of each billing period.
For annual subscriptions: credits are allocated monthly (not all at once), even though you are billed annually.
Unused credits do not roll over and expire at the end of each monthly cycle.
Credits are non-refundable, non-transferable, and have no cash value.

4.3 Usage Limits and Fair Use

We enforce usage limits to protect service stability and prevent abuse:

Daily prediction caps: Basic: 17 predictions/day; Pro: 15 predictions/day; Max: 80 predictions/day. These caps act as safety limits on top of your monthly credit allocation.
Concurrency limit: 1 prediction in progress per user at a time.
Failed predictions: If a prediction fails due to a system error, we will automatically restore the credits used for that request.

We may adjust these limits, credit rules, or plan benefits with reasonable notice by updating the pricing page or in-product messaging.

4.4 Downloading and Export

You may download generated prediction reports as PDF files for your personal or professional use, subject to the restrictions in these Terms. There is no separate commercial-use restriction on report downloads — all paid plans include the right to use reports for internal business purposes.

5. Pricing, Payments, and Taxes

Payments are processed by PayPal and Creem.
Prices are shown in USD.
You authorize us (and our payment processors) to charge applicable fees for your selected plan, including recurring charges until cancellation.
You are responsible for any applicable taxes, duties, or similar governmental assessments.
Prices are subject to change with reasonable notice to users.

6. Cancellation and Refund Policy

6.1 Cancellation

You may cancel your subscription at any time through your account settings.
Upon cancellation, you retain access to the Service until the end of your current billing period.
After cancellation takes effect, your monthly credit allocation will stop and any remaining credits will expire.

6.2 Refunds

Subscriptions are generally non-refundable once a billing period has begun.
We do not provide refunds for unused credits within a billing period.
Failed predictions: If a prediction fails due to a system error, we will automatically restore the credits consumed for that request. This is an in-product credit restore, not a monetary refund.
Exceptional circumstances: In rare cases, refunds may be considered at our sole discretion on a case-by-case basis. Any such refund does not create an obligation for future refunds.

7. Your Content and Generated Outputs

7.1 Your Responsibilities

You are responsible for:

The topics, questions, and documents you submit
Ensuring you have the necessary rights and permissions to use any uploaded content
How you use the generated prediction reports

Do not use the Service to violate any law or any third-party rights (including copyright, trademark, privacy, publicity/personality rights, or other proprietary rights).

7.2 Ownership / Rights in Outputs

As between you and us, you retain your rights in your inputs. Subject to these Terms and applicable law, you may use generated prediction reports for personal or professional purposes, including internal decision-making, research, planning, and presentation to stakeholders within your organization.

7.3 License to Operate the Service

You grant us a limited, worldwide, non-exclusive license to host, process, transmit, store, and display your inputs and generated reports solely to provide, maintain, secure, and improve the Service, including:

Generating prediction reports and delivering results
Providing prediction history features
Enforcing usage limits and preventing abuse
Troubleshooting and customer support

8. Content Restrictions

You are strictly prohibited from using MiroFish to generate, request, or distribute content that is illegal, sexually explicit, exploitative of minors, or that targets specific real individuals with defamatory, harassing, or threatening intent. Violation of this policy may result in immediate account termination without refund.

9. Prohibited Activities

You agree not to use the Service to generate, upload, distribute, or facilitate content that:

Violates any law or promotes illegal activities
Contains hate speech, discrimination, or promotes violence against individuals or groups
Is fraudulent, deceptive, or designed to mislead others (including phishing, spam, or malware distribution)
Infringes copyrights, trademarks, rights of publicity, privacy rights, or other intellectual property or proprietary rights
Targets real individuals for defamation, harassment, or threats
Harasses, threatens, or bullies any person
Spreads misinformation or disinformation intended to cause harm

You also agree not to:

Attempt to bypass usage limits, rate limits, or other technical restrictions
Use automated scripts, bots, or other tools to abuse the Service
Interfere with service operations, security, or other users' access
Reverse engineer, decompile, or attempt to extract the source code of the Service

Enforcement: We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice, and without refund where permitted by law.

10. Prediction Output Disclaimer

Reports are AI-generated scenario simulations, not factual forecasts. Outputs reflect modeled stakeholder behavior based on your inputs and the underlying AI models, and may be inaccurate, incomplete, or unsuitable for any specific decision.
Not professional advice. Reports do not constitute and must not be relied upon as legal, financial, investment, medical, accounting, tax, or other professional advice. You should consult qualified professionals before acting on any prediction.
No guarantee of accuracy. We do not guarantee any specific quality, accuracy, calibration of confidence scores, or fitness for a particular purpose.
You are solely responsible for reviewing reports and verifying any factual or quantitative claims before relying on them.

11. Privacy

Our data practices are described in our Privacy Policy. By using the Service, you consent to those practices.

12. Service Availability and Changes

We aim to keep the Service available but do not guarantee uninterrupted operation.
We may modify, suspend, or discontinue features, limits, or the Service at any time, including for maintenance, security, cost-control, or business reasons.
We will make reasonable efforts to provide advance notice of significant changes.

13. Termination

You may stop using the Service at any time.
We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses risk to the Service or others.
Upon termination, your right to use the Service ends immediately.
We may retain certain information as required by law or for legitimate business purposes.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY PARTICULAR PREDICTION QUALITY, ACCURACY, OR RESULT.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MIROFISH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY DECISIONS MADE BASED ON PREDICTION REPORTS.

16. Indemnification

You agree to indemnify and hold harmless MiroFish and its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of:

Your use of the Service
Your violation of these Terms
Your violation of any law or third-party rights
Content you submit or generate through the Service
